A judge who deems a respondent not competent or unable to participate in the immigration proceedings decides the safeguards to be implemented.  This may include issuing an order of continuance and facilitating a treatment course. The Department of Homeland Security may transfer detained individuals to specialized psychiatric units.  The court may set progress reviews every sixty or ninety days.

At times, the immigration judge may implement safeguards within the courtroom itself, which facilitate the respondent’s participation and maintain due process.  For example, the immigration judge may approve telephonic appearances if hospital admission prevents travel, hearing delays may be permitted, and visual aids may be permitted to ensure the respondent understands what is happening in court.
